INTORDUCTION
The Minerals Commission is a government agency established under the Constitution of Ghana. The Commission is responsible for the regulation and management of the utilization of the country’s mineral resources and the coordination and implementation of policies relating to the mining industry of Ghana.
The objectives of the Commission include the efficient management of the minerals resources of the country to deliver value to its stakeholders and the country as a whole. The achievement of these strategic objectives among other things depends on the employment of efficient in- house and outsourced private legal professionals. The Minerals Commission therefore intends to apply part of its budgetary allocation to fund eligible payments under a contract for the provision of Legal Services.
RATIONALE FOR THE ASSIGNMENT
To address litigation issues, the commission relies on in-house counsel as well as private Law Firms.
The decision to outsource services to a Law Firm is based on factors which include professionalism, relevant expertise, geographical considerations and urgency.
Law Firms are used to deliver legal services where demand for services exceeds available internal resources and/or expertise. Generally, engagements in respect of the following types of activities are considered to be ‘legal service’’:
The Minerals Commission will determine the scope of legal services to be provided to ensure that it meets the requirement of the Commission.
SCOPE OF SERVICES OF THE CONSULTANT (TERMS OF REFERENCE)
The successful law firm will be required to perform, inter alia, the following legal services as requested by the commission:

Duration
The duration of this assignment is expected to be two (2) years, starting from the date of award of contract.
SELECTION OF FIRMS
Firms will be selected in accordance with the Public Procurement Act, 2003(Act 663) as amended and the Guidelines of the Public Procurement Authority (PPA) in Ghana.
